The Right to Appeal and Legal Action
Policyholders covered under ERISA have the right to appeal a denied claim, and to have an independent review of the claim. Non-ERISA disability policyholders have the right to report bad faith denied to state regulators and to hire and attorney to file suit against their insurance provider.
